Dr Mithilesh Kumar, the Joint Director of the state’s Food and Drug Administration, pleaded for mercy. However, the court was not swayed and criticized the FDA for not taking appropriate action. The court highlighted that the Uttarakhand FDA had previously issued only a warning to Patanjali despite warnings from the Ministry of Health. It emphasized that the law does not provide for warnings and criticized the FDA for taking inadequate action. The court also criticized the licensing inspector for remaining silent and questioned the officer’s understanding of the law and the steps taken to address the issue. It instructed the officer to register and take appropriate measures to address the situation. Additionally, the court raised concerns about the AYUSH Ministry’s inaction against Patanjali for its misleading advertisements that undermined contemporary medicine. The court was hearing a contempt case against Patanjali for continuing to publish ads with false claims despite being directed to stop. This development follows a previous directive to Patanjali to cease all misleading advertisements, which the company had agreed to but allegedly continued to violate.
