Meanwhile, the Delhi Chief Minister has approached the Supreme Court to challenge a Delhi High Court order that dismissed his plea against his arrest by the Directorate of Enforcement (ED) in connection with the Excise policy case. The Delhi High Court’s decision stated that Kejriwal’s arrest is not in violation of the law and cannot be termed “illegal.” Nevertheless, the Aam Aadmi Party remains hopeful of receiving justice from the Supreme Court. The High Court emphasized that the accused’s arrest and remand should be evaluated in accordance with the law, rather than the timing of elections. On the other hand, Kejriwal’s challenge to the timing of his arrest before the general elections, in the absence of any mala fide intention on the part of the ED, was deemed unsustainable by the court. Kejriwal was arrested on March 21 and subsequently sent to judicial custody until April 15, 2024 by the trial court. The ED alleged that the Aam Aadmi Party (AAP) is the primary beneficiary of the proceeds of crime linked to the alleged liquor scam. Furthermore, the agency asserted that Kejriwal was directly involved in the formation of the excise policy. The case revolves around purported irregularities and money laundering in formulating and implementing the Delhi Excise Policy 2022, which was subsequently annulled.
