Mumbai Bus Body Ordered to Pay Rs 15.6 Lakh to Family of Man Killed in BEST Bus Accident admin, April 11, 2024 The man’s wife and daughter sought Rs 25 lakh and interest as compensation after claiming that Umakant Yadav was hit by a BEST bus while crossing the road in the Kalachowki area of Mumbai in February 2018. Yadav died while undergoing treatment, and in their application, his wife and daughter alleged that the bus was being driven rashly. BEST, however, contended that Yadav was under the influence of liquor at the time of the accident. They submitted that Yadav was working in an oil depot and earning Rs 15,000 per month when the accident occurred. However, the MACT Mumbai observed that the accident was a result of the BEST bus being driven negligently, and there was no evidence to prove that Yadav was drunk at the time of the accident. The tribunal also noted that the family could not prove Yadav’s occupation and income. As a result, the MACT order stated that in the absence of proof of income, it would be reasonable to consider Rs 8,000 per month as the notional income of the deceased, given that he was maintaining a family of four persons. Consequently, the MACT directed BEST to pay Rs 15.66 lakh along with interest as compensation, allocating Rs 7 lakh to the man’s daughter and the rest to his widow.
