An FIR was filed at the Dankaur police station under sections 363, 366, and 376 of the Indian Penal Code (IPC) and POCSO Act. In the court hearing, the Defense Counsel appealed for a minimum punishment for the accused, citing his status as the sole earner for his impoverished family and his lack of criminal history. However, the Special Public Prosecutor argued for maximum punishment, emphasizing the severity of the offense against a minor. The judge ruled that the evidence was sufficient to convict Mohit of the charged offenses under sections 366, 376 IPC, and section 4 of the POCSO Act. Consequently, Mohit was sentenced to 10 years of rigorous imprisonment and a fine of Rs 50,000 under section 4 of the POCSO Act, as well as five years of rigorous imprisonment and a fine of Rs 5,000 under section 366 of IPC. The judge ordered that the convict’s original sentences would run concurrently and that 85% of the fine imposed on the convict would be allocated to the victim’s rehabilitation expenses. Additionally, the court addressed a discrepancy regarding the victim’s age, concluding that she was a minor at the time of the offense regardless of the conflicting claims about her age.
