Delhi High Court dismisses husband’s adultery claim based on photographs. admin, June 10, 2024 The court recently made a ruling about the use of photographs as evidence in the age of “deepfake” technology. The court emphasized the need for proper verification of photographs before admitting them as evidence in family court proceedings. Justices Rajeev Shakdher and Amit Bansal observed that in the pictures examined, it was unclear whether the woman depicted was actually the wife in question. The court acknowledged the prevalence of deepfake technology and highlighted the necessity for the husband to substantiate the authenticity of the photographs as part of his evidence in the family court. Both parties were granted the opportunity to present their evidence in the ongoing divorce proceedings. The case revolved around a family court order requiring the husband to pay monthly maintenance to his wife and daughter. The court noted that the wife, who held a post-graduate degree in Mass Communication, was unemployed and residing with her parents after the separation. The husband had appealed against the maintenance order, citing the wife’s alleged adultery. However, the high court found that the adultery allegation was not raised in the family court and upheld the maintenance order, ultimately dismissing the husband’s appeal.
