Man Sentenced to 15 Years in Prison for Raping and Kidnapping Minor in Noida admin, June 8, 2024 The accused and the survivor belong to the same village. The Special POCSO Court Judge Vikas Nagar imposed concurrent punishments, along with a penalty of Rs 55,000 on the convict, Mohit, a resident of Greater Noida. Mohit was accused of abducting and raping a 16-year-old girl in April 2017. The FIR was registered at Dankaur police station under sections 363, 366, and 376 of the IPC and provisions of the POCSO Act. During the trial, the Defence Counsel pleaded for minimal punishment, citing the accused’s status as the sole earner in a financially struggling family, and his lack of prior criminal records. On the other hand, Special Public Prosecutor Jai Prakash Bhati argued against leniency, emphasizing the severity of the offense against a minor. Following a thorough examination of the evidence, Judge Nagar concluded that the accused is guilty of the charged offenses. As a result, Mohit was convicted and sentenced to 10 years of rigorous imprisonment and a fine of Rs 50,000 under section 4 of the POCSO Act, and five years of rigorous imprisonment and a fine of Rs 5,000 under section 366 of the IPC. The judge ordered that the sentences would run concurrently, and 85% of the fine imposed would be allocated to the victim’s rehabilitation expenses. The court also noted a discrepancy in the victim’s age, with her father claiming she was 13 years old at the time of the incident while official documents indicated she was around 16 years old.
